Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of anrkpartners.in and any products, services, or communications provided by Anrk Partners (“we”, “us”, “our”). By using our website or engaging our services, you agree to these Terms.

1) Eligibility & Account

• You must be legally capable of forming a binding contract under applicable law.
• When creating an account or submitting forms, you agree to provide accurate, complete, and current information and to keep it updated.

2) Services Scope

We offer HR & workforce solutions including recruitment, staffing (including contractual), HR outsourcing (payroll, compliance, onboarding, documentation), talent development, employer branding, academia connect, and BPO for sales & appointment setting. Service specifics, deliverables, timelines, and commercials may be defined in separate proposals, emails, SoWs, or MSAs which, when executed, form part of these Terms.

3) Proposals, Fees & Payments

• Quotes/Proposals are typically valid for a limited time and may exclude taxes and out-of-pocket expenses unless stated otherwise.
• Unless agreed, invoices are due on receipt or as per the agreed milestone schedule. Late payments may attract interest as per applicable law and/or suspension of services.
• Refunds (if any) are governed by the specific service agreement or local consumer laws.

4) Candidate & Client Obligations

• Clients shall provide accurate job requirements, timely feedback, and necessary access to stakeholders/systems to enable delivery.
• Clients are responsible for final hiring decisions, background checks (unless engaged separately), and compliance with employment laws.
• Candidates shall provide truthful information and comply with applicable employer policies and laws.

5) Intellectual Property & License

• All website content (text, graphics, UI, trademarks) is owned by us or our licensors. You may not copy, distribute, or create derivative works without written permission.
• Materials delivered under paid engagements are licensed or assigned as specified in the relevant agreement. Absent express assignment, we grant a limited, non-transferable license for internal use.

6) Confidentiality

Both parties agree to keep confidential information disclosed by the other party confidential and use it solely for fulfilling the engagement, except as required by law or with consent.

7) Data Protection

Processing of personal data is governed by our Privacy Policy. You represent you have lawful bases to share any personal data with us and will provide necessary notices/consents to data subjects where required.

8) Acceptable Use

• No misuse of the website (malware, scraping, spamming, reverse engineering, or security breaches).
• No unlawful, defamatory, infringing, or harmful content submissions.

9) Third-Party Tools & Links

We may use third-party platforms (e.g., job boards, ATS, CRM, analytics, communication tools like WhatsApp Business). We are not responsible for third-party content, availability, or policies.

10) Warranties & Disclaimers

• Services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted, error-free operation or specific outcomes (e.g., guaranteed hires, placements, performance).
• To the maximum extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

11) Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, lost profits, or business interruption. Our aggregate liability for claims arising from or related to the services shall not exceed the total fees paid by you for the specific service giving rise to the claim during the 3 months preceding the claim.

12) Indemnity

You agree to indemnify and hold us harmless from claims, losses, liabilities, and expenses arising out of your breach of these Terms or violation of law or third-party rights.

13) Termination

Either party may terminate for convenience or material breach per the applicable agreement. Upon termination, accrued fees become payable; confidentiality, IP, limitation, and dispute provisions survive.

14) Governing Law & Dispute Resolution (India)

These Terms are governed by the laws of India. Subject to arbitration, courts at Bengaluru, Karnataka shall have exclusive jurisdiction. Disputes shall be referred to a sole arbitrator mutually appointed, under the Arbitration and Conciliation Act, 1996, seat and venue at Bengaluru, proceedings in English.

15) Changes to Terms

We may update these Terms from time to time. Changes become effective when posted here with the “Last Updated” date. Continuing to use the website/services constitutes acceptance.

• Client & Billing Data: organization details, invoicing info.

• Communications: emails, forms, WhatsApp Business/chat interactions, call notes.

2) How We Use Data (Purposes & Legal Bases)

• Provide services & respond to inquiries (contract/legitimate interest).

• HR outsourcing & BPO delivery (contract/legal obligation).

• Business transfers: in merger, acquisition, or restructuring scenarios.

5) International Transfers

Data may be processed outside India by trusted processors with appropriate safeguards (contractual, technical, organizational).

6) Data Security

We employ reasonable administrative, technical, and physical safeguards to protect personal data; however, no method is 100% secure.

7) Data Retention

We retain personal data only as long as necessary for the purposes above, to comply with legal obligations, resolve disputes, and enforce agreements. Candidates may request profile deletion (subject to legal/contractual retention).

8) Your Rights

• Access, correct, update your data.
• Withdraw consent for marketing at any time.
• Request deletion (subject to lawful bases/retention obligations).
• Object to/limit certain processing as per applicable law.

9) Children’s Privacy

Our services are not directed to children under 18. We do not knowingly collect data from children. If you believe a child has provided data, contact us to remove it.

10) WhatsApp Business & Communications

When you message us on WhatsApp Business or similar channels, we may store your contact details and conversation history to serve you. Messaging implies consent to receive replies and service updates. You may opt out by replying “STOP”.
